1. Acceptance of Terms

By accessing or using HostClaw ("Service", "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use our Service. We provide managed hosting for the OpenClaw ecosystem (e.g. Clawdbot, Moltbot, OpenClaw) and related tools.

2. Account and Registration

You must create an account to use certain features. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account. You must be at least 13 years old (or the age of consent in your jurisdiction) to use the Service.

3. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws.
• Abuse, harm, or attempt to gain unauthorized access to our systems, other users, or third-party services (including Discord, Telegram, or AI providers).
• Resell or sublicense the Service without our written permission.
• Use the Service to distribute malware, spam, or content that infringes others' rights.
• Circumvent usage limits, security measures, or fair-use policies.

We may suspend or terminate your account if we reasonably believe you have violated these terms.

4. Your Content and API Keys

You retain ownership of content and data you provide (e.g. API keys, bot tokens, configuration). By providing them, you grant us the rights necessary to operate the Service (e.g. to run your bots and call third-party APIs on your behalf). You are responsible for ensuring you have the right to use and share any keys or tokens you provide, and for complying with third-party terms (e.g. Discord Developer Terms, Google AI terms).

5. Service Availability and Changes

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice where possible. We are not liable for downtime, data loss, or impacts on your bots or downstream users beyond what is required by applicable law.

6. Payment and Billing

Where payment is required, you agree to pay all fees according to the pricing in effect at the time. Fees may change with notice. Refund policy will be stated at the point of purchase. You are responsible for any taxes applicable to your use of the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Service will be error-free or secure.

8. Limitation of Liability

To the maximum extent permitted by law, HostClaw and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless HostClaw and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

You may close your account at any time. We may suspend or terminate your account or access to the Service for violation of these Terms or for other reasons with notice where practicable. Upon termination, your right to use the Service ceases; we may retain or delete your data as described in our Privacy Policy.

11. General

These Terms constitute the entire agreement between you and HostClaw regarding the Service. We may update these Terms by posting a new version on this page; continued use after changes constitutes acceptance. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right.
